MEMBERSHIP TERMS AND CONDITIONS

1. Overview

   To be an American Home Schools member you must agree to abide by all of the terms and conditions contained in this Agreement. Please read carefully before registering and becoming a member of our Web Site. By registering as a member of the Web Site, you indicate your acceptance of this Agreement and its terms and conditions. If you do not accept this Agreement, you will not be allowed to register as a member of the Site.
    

2. Service Provided

   In consideration of your compliance with the terms and conditions of this Agreement, we will provide you with the content, tools and services available to registered members of the Web Site and grant you permissions and licenses as set forth in Section 3.

   We reserve the right, at our discretion, to change, modify, add or remove portions of this Agreement and the Services at any time. You must review this Agreement from time to time so you will be apprised of any changes. We may change, suspend or discontinue any aspect of the Service at any time, including the availability of any Service feature, database or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.

   If this Agreement or any future changes are not acceptable to you or cause you no longer to be in compliance with this Agreement, you must immediately cease activity as a member of the Web Site and notify us by email to remove your username and password. Failure to do so after any changes to this Agreement means that you have accepted all such changes.
    

3. Limited License

   In consideration of your compliance with the terms and conditions of this Agreement, American Home Schools grants you a personal, nonexclusive license to access and use the Service. Title to and ownership of the Service shall be and at all times remain in the possession of American Home Schools. You will have access to information, communications, photos, text, video, graphics, music, sounds, images and other material and services posted by us or third party service providers and designated for your use. We grant to you a personal, nonexclusive license to download eBooks, software, calculators, converters and other downloadable content only from designated download areas.  All other use of our Content, including but not limited to, modification, publication, transmission, participation in the transfer or sale of, reproduction, creation of derivative works from, distribution, performance, display, incorporation into another web site, mirroring the Service, or in any other way exploiting any of the Content, in whole or in part, is prohibited. Unauthorized use of our Content will violate worldwide copyright and trademark laws.
    

4. Site Access
   
   You are responsible for maintaining the confidentiality of your user ID and password. You are responsible for all uses of your user ID, whether or not authorized by you. You must immediately notify us of any unauthorized use of your user ID or password.
    

5. Privacy Policy
   
   By registering with us you agree to allow us to use your email address for specific advertising campaigns of our products and services, including those of our sponsors. No other individual, group, company, or organization will be provided with this information.
    

6. Membership Fees
   
   Until such time as deemed possible (through proper level of sponsorship revenue)  the annual Membership Fee will stand at $29.95US, non-refundable. Free membership will be possible and introduced when sponsorship revenue is high enough to warrant such an action. It is our general intention to provide our services for free to any individual or company interested in such membership. We reserve the right to increase membership fees (and product prices) when deemed necessary.
    

7. Submissions
   
   Submissions of articles, forum discussions, and general information is encouraged. As a user of the Site, you may not:

   - post material that is copyrighted, unless you are the copyright owner or have the permission of the copyright owner to post it;
   - post material that reveals trade secrets, unless you own them or have the permission of the owner;
   - post material that infringes any intellectual property rights of others or their privacy or publicity rights;
   - post material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity;
   - post a sexually-explicit image or statement;
   - post advertisements or solicitations for business without our approval;
   - post chain letters, pyramid schemes, or similar content; or
   - impersonate another person.
    

8. Disclaimers

   We have no obligation to screen communications in advance and are not responsible for screening or monitoring material posted by users or members. If we are notified of communications or materials that do not conform to this Agreement, we may investigate the allegation and determine at our sole discretion whether to modify or remove the communication. We may also terminate the account of the responsible member or take such other action as we deem fit. We have no liability or responsibility to users or members for performance or non-performance of such activities.

   We do not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by sponsors or members or endorse any opinions expressed by sponsors or members. You acknowledge that any reliance on material (including links and third party information) posted on the Web Site will be at your own risk.

   WE DO NOT WARRANT, AND TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW WE DISCLAIM, ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE SPECIFICALLY DISCLAIM ANY WARRANTY (A) THAT THE SITE OR SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, (B) THAT DEFECTS WILL BE CORRECTED, (C) THAT THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS, (D) THAT THE SECURITY METHODS EMPLOYED WILL BE SUFFICIENT, OR (E) REGARDING CORRECTNESS, ACCURACY, OR RELIABILITY. IF YOUR USE OF THE WEB SITE, THE SERVICE, OR THE CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACEMENT OF EQUIPMENT OR DATA, WE ARE NOT RESPONSIBLE FOR THOSE COSTS.

   TO THE FULLEST EXTENT PERMITTED BY LAW, AMERICAN HOME SCHOOLS DISCLAIMS ANY WARRANTIES FOR SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE WEB SITE OR RECEIVED THROUGH ANY LINKS PROVIDED ON THE WEB SITE, AS WELL AS FOR ANY INFORMATION OR ADVICE RECEIVED THROUGH THE WEB SITE OR THROUGH ANY LINKS PROVIDED ON THE WEB SITE. AMERICAN HOME SCHOOLS SIMILARLY DISCLAIMS, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY WARRANTIES FOR ANY INFORMATION OR ADVICE OBTAINED THROUGH OUR WEB SITE.
    

9. Limitation of Liability

   NEITHER WE NOR OUR SERVICE PROVIDERS SHALL BE LIABLE FOR (I) ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE WEB SITE, THE SERVICE OR ANY CONTENT OR OTHER INFORMATION PROVIDED ON OR THROUGH THE WEB SITE, THE SERVICE OR ANY OTHER HYPERLINKED WEB SITE, INCLUDING WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, OR LOSS OF PROGRAMS OR OTHER DATA, EVEN IF WE OR ONE OF OUR REPRESENTATIVES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS OR OTHER INACCURACIES IN THE WEB SITE, THE SERVICE, OR ANY HYPERLINKED WEB SITE.

   SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE WEB SITE OR RECEIVED THROUGH ANY LINKS PROVIDED ON THE WEB SITE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED ON THE WEB SITE OR RECEIVED THROUGH ANY LINKS PROVIDED ON THE WEB SITE.
   
   You shall indemnify, and hold harmless American Home Schools and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, relating to your use of the Service or alleging or resulting from your breach of the terms of this Agreement.
    

10. Termination of Membership

    You may terminate your membership at any time by notifying us via email. Upon termination, your access to the Service will be terminated. You are responsible for all Membership fees and activity under your account that have accrued up to the time that your account is deactivated. No refund of any kind is expressed or allowed.

    We may, in our sole discretion, terminate or suspend your access to all or part of the Service for any reason, including without limitation, breach of this Agreement or transfer of this Agreement by you. No refund of any kind is expressed or allowed.

    Membership termination disables your ability to access records. These may be transferred to a point of your selection for a processing fee of $45, payable in advance.
