West Virginia Code §18-8-1 allows for home instruction so long as the parent(s) give the county board of education: [1] notice of intent to provide home instruction at least two weeks prior to withdrawing child from public school, and [2] evidence that instructor(s) have at least the equivalent of a high school diploma.

Summary:

Homeschooling regulations allow for instruction in the home or other place approved by the county board of education and is to be for a time equal to the school term of the county (180 days); to be conducted by a person or persons who, in the judgment of the county superintendent and county board, are qualified to give instruction in subjects required; if requested, provide information and records with respect to attendance, instruction, and progress of pupils.

The person or persons providing the instruction must present to the county superintendent or board of education a notice of intent to provide home instruction with the name, address, age, and grade level of any child of compulsory school age to be instructed.
